Business Day - means a day from Monday to Friday, excluding Saturdays, Sundays, and public holidays.
1.2
Customer, Service Recipient - means a Consumer or Entrepreneur who intends to become or is a party to an Agreement with Kalais Bricks.
1.3
Account - means a service provided by Kalais Bricks that enables the Customer to place Orders and collects data and information about the Customer's activity in the Online Store at bricks.kalais.net.
1.4
Consumer - means a natural person concluding a legal transaction with the entrepreneur that is not directly related to their business or professional activity.
1.5
Entrepreneur – means a natural person, legal person, or organizational unit without legal personality, to which the law grants legal capacity, conducting business or professional activities in its own name and on its own account.
1.6
Terms and Conditions – means these Terms and Conditions of the bricks.kalais.net Online Store. If the Customer concludes an Agreement, the Terms and Conditions constitute an integral part of the Agreement between the Customer and Kalais Bricks. The Terms and Conditions are made available to Customers free of charge in accordance with the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2013, item 1422, consolidated text, as amended).
1.7
Online Store – means the online store available at the following internet address: bricks.kalais.net, operated by the entrepreneur: Dominik Skarbek-Kruszewski, conducting business under the name "Kalais Studios Dominik Skarbek-Kruszewski", entered into the Central Register and Information on Business Activity maintained by the minister responsible for economic affairs, with the business address and correspondence address: ul. Znanieckiego 16/46, 03-980 Warsaw, Poland, NIP 1132446207, REGON 363154839, email address: bricks@kalais.net, phone number: +48 603 503 187.

Agreement – means the sales agreement for products offered by Kalais Bricks concluded between Kalais Studios Dominik Skarbek-Kruszewski and the Customer via the bricks.kalais.net Online Store.
1.9
Kalais Bricks, Service Provider – means the entrepreneur: Dominik Skarbek-Kruszewski, conducting business under the name "Kalais Studios Dominik Skarbek-Kruszewski", entered into the Central Register and Information on Business Activity maintained by the minister responsible for economic affairs, with the business address and correspondence address: ul. Znanieckiego 16/46, 03-980 Warsaw, Poland, NIP 1132446207, REGON 363154839.
1.10
Order – means the order form submitted electronically on the website bricks.kalais.net by the Customer.
§ 2 GENERAL PROVISIONS
2.1
These Terms and Conditions define the scope, rules, and conditions of use of the bricks.kalais.net Online Store by Customers.
2.2
The bricks.kalais.net Online Store offers Customers: Consumers and Entrepreneurs, information about the products presented on the website www.bricks.kalais.net, the ability to place an Order, which, after acceptance by Kalais Bricks, results in the conclusion of a Sales Agreement for the specified products to the Customer.
§ 3 RULES OF USE OF THE ONLINE STORE
3.1
The Customer's use of the bricks.kalais.net Online Store is voluntary.
3.2
To use the bricks.kalais.net Online Store, the Customer agrees to accept and comply with the Terms and Conditions.
3.3
To purchase products presented in the bricks.kalais.net Online Store, the Customer may place an Order.
3.4
You do not need an account to place an order.
3.5
In order for the Customer to use the bricks.kalais.net Online Store, the following technical requirements for the Customer's equipment enabling interoperability with the Kalais Bricks IT system are required:
3.5.1
a computer, laptop, or other multimedia device with Internet access;
3.5.2
Email access;
3.5.3
Web browser: supporting HTML version 4.01 or later and CSS version 2.1 or later;
3.5.4
Placing an order involves selecting a product, clicking the "Buy" button, filling out your details – email account, payment method, and accepting the terms and conditions and personal data processing.
§ 4 RULES FOR CONCLUDING CONTRACTS
4.1
The Customer may conclude a Sales Agreement for a specific product listed in the bricks.kalais.net Online Store by placing an Order.
4.2
The condition for accepting the Order for processing is that the Customer correctly completes all required fields during the Order placement process.
4.3
When placing an Order, the Customer is obligated to provide truthful information.
4.4
A correctly placed Order will be confirmed by Kalais Bricks via a message on the website, along with payment instructions.
4.5
When the Buyer places an order and clicks the "Order and pay" button, a Contract is concluded between Kalais Studios Dominik Skarbek-Kruszewski and the Customer.
4.6
The Contract is concluded for a fixed term until the date of fulfillment of the Order.
4.7
The place of performance of the Agreement is the Seller's registered office address.
4.8
After confirming the Order, the Customer is obligated to pay for the product.
§ 5 PRODUCT DELIVERY
5.1
Product delivery is electronic only. The product is sent to the email address.
5.2
Products ordered from the bricks.kalais.net Online Store are delivered to the email address provided by the Customer when placing the order.
5.3
The bricks.kalais.net online store delivers ordered products exclusively electronically.
5.4
The product delivery time depends on the payment and is within a maximum of 7 business days from the date the payment is credited to the seller's account.
5.5
If the Order cannot be completed within the time specified in the Agreement due to reasons attributable to Kalais Bricks, the Customer will be informed of this fact and the expected delivery date. Information regarding this matter will be sent to the Customer via email to the address provided in the Order.
§ 6 PRODUCT PRICES AND DELIVERY COSTS
6.1
The prices and descriptions of the products available on the bricks.kalais.net Online Store website constitute commercial information only and do not constitute an offer within the meaning of Article 66 of the Civil Code.
6.2
By placing an Order on the bricks.kalais.net Store website, the Customer is making an offer to purchase a specific product under the terms specified in the product description on the website www.bricks.kalais.net. The price applicable to the Customer is the price at the time of placing the Order.
6.3
Prices in the bricks.kalais.net online store are expressed in Polish zloty and include VAT.
6.4
Each price includes 5% VAT on e-books. A receipt is issued for every order.
6.5
Shipping is free.
6.6
For the purchase of the product, the Customer may pay Kalais Bricks in one of the following forms:
6.6.1
payment by bank transfer to Kalais Bricks' bank account.
6.6.2
PayPal payment to the Kalais Bricks email adress.
6.7
The Customer is obligated to make the payment within 7 calendar days from the date of conclusion of the Agreement.
§ 7 COMPLAINTS
7.1
Kalais Bricks undertakes to provide Customers with new products, free from physical and legal defects (warranty), and legally introduced to the Polish market.
7.2
The Customer has the right to submit complaints to Kalais Bricks for non-performance or improper performance of the Agreement, including under the warranty.
7.3
Complaints may be submitted in writing to the following address: Znanieckiego 16 m46, 03-980 Warsaw, Poland, or electronically via email to: bricks@kalais.net.
7.4
A complaint should include: the Customer's name and surname, address, telephone number, the subject of the complaint, and a description of the circumstances justifying the complaint.
7.5
If the complaint referred to in point 7.4 above does not meet the conditions specified in point 7.4 above, Kalais Bricks will inform the Customer to immediately supplement it, advising that failure to supplement the complaint within 14 days will result in the complaint not being processed.
7.6
Kalais Bricks will consider complaints within 14 days of receiving them. If Kalais Bricks does not respond to the Customer's complaint within 14 days, it means that the complaint has been deemed justified.
7.7
Under the warranty for defects, if the sold product has a defect, the Customer has the right to submit a declaration of price reduction or withdraw from the Agreement, unless Kalais Bricks immediately and without undue inconvenience to the Customer replaces the defective product with a defect-free one or removes the defect.
7.8
If the Customer is a Consumer, the Consumer may, instead of having the defect removed as proposed by Kalais Bricks, request the replacement of the item with a defect-free item, or, instead of replacing the item, request the removal of the defect, unless bringing the item into compliance with the Agreement in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by Kalais Bricks. When assessing the excessive costs, the value of the defect-free item, the type and significance of the identified defect, and the inconvenience to which the Consumer would be exposed under another method of satisfaction are also taken into account.
7.9
Kalais Bricks's liability to a Customer who is not a Consumer under the warranty for physical and legal defects of the products is excluded.
§ 8 RIGHT OF WITHDRAWAL
8.1
A Customer who is a Consumer may, within 14 days of the Product being taken into their possession or by a third party designated by them other than the carrier, withdraw from the Agreement without giving any reason and without incurring any costs, except for the direct costs of returning the Product to Kalais Bricks.
8.2
The Consumer may withdraw from the Agreement by sending a written declaration of withdrawal to the address of Kalais Bricks. The declaration may be submitted on a form, the template of which is attached as Annex 2 to the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827).
8.3
If the Consumer withdraws from the Agreement, the Agreement is deemed not to have been concluded.
8.4
Kalais Bricks is obligated to immediately, but no later than within 14 days of receiving the Consumer's declaration of withdrawal from the Agreement, refund all payments made by the Consumer, including the costs of delivery. Kalais Bricks will refund the payment using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different refund method that does not incur any costs for them.
§ 9 PERSONAL DATA PROTECTION
9.1
The Controller of Customers' personal data processed in connection with the performance of the Agreement is: Dominik Skarbek-Kruszewski, conducting business under the name "Kalais Studios Dominik Skarbek-Kruszewski", entered into the Central Register and Information on Business Activity maintained by the minister responsible for economic affairs, business address and mailing address: ul. Znanieckiego 16 m46, 03-980 Warsaw, Poland, NIP 1132446207, REGON 363154839. Providing personal data by the Customer is voluntary. Customers whose personal data is processed by Kalais Bricks have the right to access, update, correct, and delete their data. Data processing is carried out in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws of 2002, No. 101, item 926, as amended) and the Electronic Services Act of July 18, 2002 (Journal of Laws of 2013, item 1422, as amended).
9.2
Customer data is provided voluntarily when placing an order. This data is processed for the purpose of fulfilling the order in the online store bricks.kalais.net. This data includes the email address.
9.3
To ensure the security of the Online Store and support Secure Shopping, the customer's IP address and browser information are automatically recorded during the order process.
9.4
The bricks.kalais.net website does not automatically collect any information about visitors, except for anonymous visitor statistics.
9.5
The Kalais Bricks Online Store does not use cookies or collect any data other than that listed in sections 9.2 and 9.3.
9.6
The Customer connects to the Store via the SSL protocol, which means the connection is secure and encrypted. All data provided by the Customer during the Order is transmitted to the Store via an encrypted and secure connection and is stored in an encrypted file.
9.7
The website is hosted (technically maintained) on the operator's servers: cyberFolks.pl
To ensure technical reliability, the hosting company maintains logs at the server level. The following may be recorded:
resources identified by the URL identifier (addresses of requested resources – pages, files),
request arrival time,
response sending time,
client station name – identification performed via the HTTP protocol,
information about errors that occurred during the execution of an HTTP transaction,
URL address of the page previously visited by the user (referrer link) – if the Website was accessed via a link,
information about the user's browser,
IP address information,
diagnostic information related to the process of self-ordering services via on-site loggers,
information related to the handling of e-mail addressed to the Operator and sent by the Operator.
§ 10 FINAL PROVISIONS
10.1
These Regulations are effective from September 16, 2025.
10.2
These Terms and Conditions are made available to Customers free of charge in accordance with the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws of 2013, item 1422, consolidated text, as amended).
10.3
Kalais Bricks reserves the right to amend the Terms and Conditions. Amendments to the Terms and Conditions will be effective on the date specified by Kalais Bricks, which may not be less than 14 days from the date the amended Terms and Conditions are made available on the Kalais Bricks website.
10.4
If the Customer does not accept the amendments to the Terms and Conditions, the Customer has the right to terminate the Agreement with immediate effect within 14 days of receiving notification of the amendments to the Terms and Conditions.
10.5
Disputes with a Customer who is a Consumer may be resolved through mediation before the competent provincial inspector of the trade inspection or by submitting the dispute to a permanent consumer arbitration court in accordance with the principles set out in the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, consolidated text, as amended).
10.6
In matters not regulated in these Terms and Conditions, the provisions of generally applicable law shall apply, in particular the Civil Code, the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws of 2013, item 1422, as amended), and the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827).

§ 8 RIGHT OF WITHDRAWAL

10.3
Kalais Bricks reserves the right to amend the Terms and Conditions. Amendments to the Terms and Conditions will be effective on the date specified by Kalais Bricks, which may not be less than 14 days from the date the amended Terms and Conditions are made available on the Kalais Bricks website.
10.4
If the Customer does not accept the amendments to the Terms and Conditions, the Customer has the right to terminate the Agreement with immediate effect within 14 days of receiving notification of the amendments to the Terms and Conditions.
10.5
Disputes with a Customer who is a Consumer may be resolved through mediation before the competent provincial inspector of the trade inspection or by submitting the dispute to a permanent consumer arbitration court in accordance with the principles set out in the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, consolidated text, as amended).
10.6
In matters not regulated in these Terms and Conditions, the provisions of generally applicable law shall apply, in particular the Civil Code, the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws of 2013, item 1422, as amended), and the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827).
